These Terms of Use constitute a legally binding agreement between you (“you”) and Data Set Match (“Company,” “we,” “us,” or “our”), concerning your access to and use of the https://www.formulabyte.com website and any related mobile websites, apps, or services (collectively, the “Site”). By accessing the Site, you agree to these Terms in full. If you do not agree, you must discontinue use immediately.
1. Agreement to Terms
Supplemental terms or documents posted on the Site from time to time are incorporated herein by reference. We may update these Terms at our discretion by changing the “Last Updated” date above. Your continued use after changes are posted constitutes acceptance. Users are responsible for complying with all applicable laws and for ensuring they meet minimum age requirements.
2. Intellectual Property Rights
Unless otherwise noted, the Site, its Content, and Marks are owned by or licensed to us and protected by applicable laws. You are granted a limited, non-transferable license to access and use the Site for personal, non-commercial purposes. All rights not expressly granted are reserved.
3. User Representations
By using the Site, you represent and warrant (among other things) that your registration data is accurate and current; you have legal capacity; you are not under 13; you will not use bots or unlawful means; and your use complies with applicable law. We may suspend or terminate accounts for violations.
4. User Registration
You may be required to register and keep your password confidential. We may remove or reclaim usernames deemed inappropriate.
5. Prohibited Activities
You agree not to misuse the Site, including but not limited to automated scraping, security circumvention, infringement, harassment, unlawful activity, malicious uploads, reverse engineering (except as permitted by law), or using the Site to compete with us.
6. User Generated Contributions
Contributions may be visible to others. You warrant you own or have rights to post the material and that it does not violate rights or laws, nor contain unlawful or objectionable content. We may moderate, edit, or remove content at our discretion.
7. Contribution License
By posting Contributions, you grant us a worldwide, perpetual, irrevocable, transferable, royalty-free license to host, use, reproduce, publish, and create derivative works, including sublicensing. You waive moral rights where permitted.
8. Submissions
Feedback and suggestions you provide become our property and may be used without restriction or compensation.
9. Site Management
We may monitor, restrict, or remove content; limit access; or otherwise manage the Site to protect our rights and ensure proper functioning.
10. Privacy Policy
Your use of the Site is subject to our Privacy Policy. By using the Site, you consent to data processing as described therein. If you access the Site from outside the United States, you consent to data transfer to, and processing in, the United States.
11. Term & Termination
We may deny access, block IPs, suspend, or terminate accounts at any time and for any reason, including breaches of these Terms.
12. Modifications & Interruptions
We may modify, suspend, or discontinue the Site (in whole or part) without notice and are not liable for downtime or service changes. For “lifetime” deals, we may discontinue all or part of the Site without notice.
13. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflicts principles.
14. Dispute Resolution
The parties will first attempt informal negotiations for 30 days. If unresolved, disputes will be resolved by binding arbitration under the Commercial Arbitration Rules of the United Kingdom, with venue generally in the UK, subject to the exceptions stated (e.g., IP enforcement, privacy violations, injunctive relief). Class or representative actions are not permitted. In no event may a dispute be brought more than one (1) year after it arose.
15. Corrections
The Site may contain errors or omissions; we reserve the right to correct or update content at any time without notice.
16. Disclaimer
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU USE THE SITE AT YOUR OWN RISK.
17. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO US IN THE ONE (1) MONTH PRIOR TO THE CLAIM.
18. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your Contributions, your use of the Site, your breach of these Terms, or your violation of third-party rights or laws.
19. User Data
We may maintain data related to Site performance and your use. You are responsible for backing up your data; we are not liable for loss or corruption of data.
20. Electronic Communications, Transactions, and Signatures
You consent to receive electronic communications and agree electronic signatures and records satisfy legal requirements for written documents.
21. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Site. If any provision is unlawful or unenforceable, the remainder remains in effect. We may assign our rights and obligations at any time.
22. Refunds
Our refund policy lasts 30 days from the date of your last payment. If more than 30 days have elapsed, we cannot offer a refund or credit. Refund eligibility also depends on usage. If you have made more than 50 total requests across products (including Generators, AI in Spreadsheets, and Data Analyzer) during this period, you are not eligible for a refund.
